The Equality and Anti-discrimination Tribunal
The Equality and Anti-discrimination Tribunal handles complaints concerning the Equality and Anti-Discrimination Ombud’s decisions.
A party that disagrees with the Ombud’s decision may bring the case to the Equality and Anti-discrimination Tribunal. The Ombud can also bring cases before the tribunal if one of the parties does not rectify its conduct in line with the Ombud’s decision.
The tribunal is an independent administrative body under the auspices of the Ministry and the King. However, this body cannot issue instructions with regard to, or reverse, the tribunal’s exercise of authority in individual cases.
The Tribunal’s authority
The tribunal can reach decisions with regard to whether there has been a breach of the law. The tribunal can order cessation, rectification and other measures that are necessary to ensure that discrimination, harassment, orders or retaliation ceases – and to hinder repetition. The tribunal can decide on a deadline for compliance with the decree.
The tribunal can make decisions on compulsory fines to ensure compliance with decrees, if the deadline for compliance has been overrun.
The tribunal cannot repeal or amend decisions made by other administrative authorities. The tribunal cannot issue decrees on how the authority to make decisions is exercised.
