Step 4 - Violation must lead to consequence

A breach of procedures should have consequences for the person harassing, whether it’s colleagues, guests or clients.

Consequences must be in proportion to the seriousness of the incident. If the allegation/report is found to be unreliable following investigation of the matter, the matter must be closed.

Harassment by customers, guests or clients

With regard to harassment by customers, guests and users all workplaces should have procedures/guidelines in place for the appropriate consequences, both for the matter at hand and for cases that may arise in the future. In cases where the company makes use of a security firm, reactions to harassment should be subject to the agreement with the security firm concerned. If the harassment falls under the Penal Code, the employer must consider reporting the matter to the police.

Consequences for customers, guests and clients may be any of the following:

  • Verbal warning
  • Eviction
  • Blacklisting
  • Report to the police

Regardless of the actions taken, the employees must be safeguarded against recurrences. The employer is obliged to put preventive measures in place.

Harassment between employees

If harassment has occurred between employees, consequences against the person found guilty of harassment may be any of the following:

  • Verbal or written warning
  • Deprivation of responsibilities or transfer
  • Dismissal with notice/or summary dismissal

If the harassment falls under the Penal Code, the employer must, in cooperation with the person who has been harassed, consider reporting the matter to the police.
